These Terms of Use (the “Terms” or “EULA”) form a license agreement between you (“you”, “the user”) and Morgane Garnier (trading as KreaRise) (“the publisher”, “we”), publisher of the Piscary mobile application (the “App”). Please read them carefully. For matters relating to your personal data, please refer to our Privacy Policy.

1. Purpose and acceptance

Piscary is a mobile fishing logbook: catch journal, species catalogue, fishing-condition scoring (weather, tides, hydrology), gear management, challenges and badges, as well as optional social features (catch sharing, likes, comments, friendships).

By downloading, installing or using the App, you fully accept these Terms. If you do not accept them, do not use the App.

2. License

Subject to your compliance with these Terms, the publisher grants you a personal, non-exclusive, non-transferable and revocable license to install and use the App on devices you own or control, strictly for personal, non-commercial purposes.

You agree not to: copy, modify, translate, decompile, disassemble or reverse engineer the App (except as permitted by law); rent, lend, resell or sublicense it; circumvent its security measures; or use it for any unlawful purpose.

3. User account

An account is required to use the App (verified email address). Once signed in, the App remains usable offline: your data is saved locally and synced to your account when the network is back.

• You are responsible for the accuracy of the information you provide and for the confidentiality of your credentials (email and password). Any activity carried out from your account is deemed to be carried out by you.
• Minimum age: 15. By creating an account, you confirm that you are at least 15 years old (the age of digital consent in France under Art. 8 GDPR). The App is not intended for children under 15.
• Notify us promptly at contact@piscary.app of any unauthorized use of your account.

4. Piscary Pro subscription (auto-renewable subscription)

The App offers a paid Piscary Pro subscription that unlocks features with ongoing value, including: multi-day marine weather forecasts, past and future fishing scores, an unlimited catch journal, advanced statistics and removal of advertising.

• Automatic renewal: the subscription renews automatically for an identical period unless you cancel it at least 24 hours before the end of the current period.
• Billing by the store: payment is charged by the Apple App Store or Google Play to the account associated with your device. Managing and cancelling the subscription is done in your store account settings (App Store or Google Play), not in the App.
• Price and duration: the price, the length of the period and the exact terms are shown in the App at the time of purchase. Any free trial is automatically followed by billing at the stated price if you do not cancel before the trial ends.
• Prices: all prices are shown inclusive of tax.
• Right of withdrawal (digital content): the subscription is digital content supplied immediately. By confirming your purchase, you expressly request its immediate performance and acknowledge that you thereby lose your 14-day right of withdrawal (Art. L221-28 of the French Consumer Code).
• Legal guarantee of conformity: the subscription benefits from the legal guarantee of conformity for digital content and services (Art. L224-25-1 et seq. of the French Consumer Code); this statutory guarantee is separate from the “as is” clause in section 9.
• Refunds: refund requests are handled exclusively by Apple or Google under the terms of the relevant store. The publisher does not process refunds.
• Independence from the Piscary account: deleting your Piscary account does not cancel your subscription. You must cancel it separately through the App Store or Google Play, otherwise billing will continue.

5. Advertising

The free version of the App displays advertising provided by Google AdMob. These ads are non-personalized: no ad targeting based on your profile and no cross-app tracking. The Piscary Pro subscription removes all advertising. For details on the data processing associated with advertising, see the Privacy Policy.

6. User-generated content (UGC) and code of conduct

Social features let you post content (catches, photos, username, comments) — your “Content”.

• Responsibility: you are solely responsible for the Content you post and you warrant that you hold the rights necessary to share it.
• Zero tolerance for objectionable content: strictly prohibited are content that is illegal, hateful, discriminatory, harassing, threatening, sexual or containing nudity, violent, defamatory, deceptive, as well as spam and any impersonation.
• Zero tolerance for child sexual abuse and exploitation (CSAE/CSAM): any content that sexually exploits, endangers or abuses a minor is strictly prohibited. Such content is removed immediately, leads to an immediate and permanent ban, and is reported to the competent authorities and specialised hotlines (such as NCMEC). To report it, use the in-app reporting tool or write to contact@piscary.app.
• Reporting and blocking: the App provides mechanisms to report content or a user and to block a user. The publisher reviews reports and may remove any objectionable content and ban the responsible user within 24 hours of receiving a report. Our single point of contact for content matters is contact@piscary.app. Where possible, we inform the reporter of the outcome.
• License to Content: in order to operate the service, you grant the publisher a limited, worldwide, non-exclusive license to host, store, reproduce and display the Content you share, solely for the purpose of providing and operating the App according to the audience you have chosen. You retain ownership of your Content.

7. Fishing-specific disclaimers

• Indicative data: weather, tides, river flow, fishing-condition scores and any regulations displayed are provided “for guidance only”, without warranty of accuracy, completeness or timeliness. Legal catch sizes, quotas, seasons and permitted zones vary locally: it is your responsibility to check and comply with local regulations and to hold the required authorizations and permits.
• Not a navigation tool: the maps and positions displayed are not intended for maritime navigation or any safety-related use. Do not rely on them to find your way at sea or to make critical decisions.
• Safety: practising fishing safely and lawfully is your sole responsibility. The publisher disclaims any liability for accidents, injuries or offences related to your fishing activity.

8. Intellectual property

The App, its code, design, text, species catalogue and content (excluding user-generated Content) are the property of Piscary or its licensors and are protected by intellectual-property laws.

• Weather, marine and hydrological data is provided by Open-Meteo and used under the Creative Commons CC BY 4.0 license (attribution).
• Some fishing icons are sourced from Game-Icons.net and used under the Creative Commons CC BY 3.0 license (attribution).

9. Warranties and limitation of liability

To the extent permitted by applicable law:

• The App is provided “as is” and “as available”, without warranty of any kind, express or implied, including fitness for a particular purpose, accuracy of data or uninterrupted availability.
• The publisher shall not be liable for indirect, incidental or consequential damages (loss of data, loss of catch, loss of profit) arising from the use or inability to use the App.
• Nothing in these Terms limits the publisher’s liability for gross negligence, wilful misconduct, personal injury or in any other case where the law prohibits it. If you are a consumer, you retain all your mandatory statutory rights, which these Terms cannot diminish.

10. Termination

• By you: you may stop using the App at any time and delete your account from Profile → Settings → Danger zone → Delete account (see also our account-deletion page).
• By us: the publisher may suspend or terminate your access, remove Content or ban your account in case of breach of these Terms, in particular the code of conduct (section 6).
• Termination does not cancel a Piscary Pro subscription, which must be managed separately through the store (section 4).

11. Governing law and disputes

These Terms are governed by French law and, where applicable, by the law of the European Union. In case of a dispute, we invite you first to contact us at contact@piscary.app to seek an amicable resolution. If you are a consumer, you also have the right to refer the dispute, free of charge, to a consumer mediator, after a prior written complaint to contact@piscary.app (the mediator’s details are provided in our Legal Notice once designated). Failing an amicable agreement, the dispute will be brought before the competent courts in accordance with applicable legal rules, including the consumer- protection rules of your country of residence.

12. Changes and contact

The publisher may amend these Terms to reflect changes to the App or the law. The “Last updated” date at the top of this document indicates the version in force. By continuing to use the App after an update, you accept the amended Terms.

13. Apple App Store — additional terms

The following terms apply only when the App is downloaded from the Apple App Store; in case of conflict, they prevail for that copy of the App.

• Parties: these Terms are concluded between you and the publisher only, not with Apple. Apple is not responsible for the App or its content.
• Scope of licence: the licence granted in section 2 is limited to use on any Apple-branded device you own or control, in accordance with the Apple Media Services Terms.
• Maintenance and support: the publisher is solely responsible for any maintenance and support. Apple has no obligation to furnish any maintenance or support services for the App.
• Warranty: the publisher is solely responsible for any product warranties. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the App (if any); to the maximum extent permitted by law, Apple has no other warranty obligation.
• Product claims: the publisher (not Apple) is responsible for addressing any claims relating to the App, including product liability, failure to conform to legal or regulatory requirements, and consumer-protection claims.
• Intellectual property: in case of a third-party claim that the App infringes intellectual-property rights, the publisher (not Apple) is responsible for its investigation, defence, settlement and discharge.
• Legal compliance: you represent that you are not located in a country subject to a US Government embargo and are not on any US Government list of prohibited or restricted parties.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
